Ancora sulla grazia a Leonard Peltier

In una lettera del 3 gennaio 2017 (*) John C. “Jack” Ryan – ex agente e socio fondatore del Federal Bureau of Investigation Agents Association (FBIAA) – ha scritto al presidente Obama chiedendo la grazia per Leonard Peltier, attivista nativo americano. Ryan ha scritto che Peltier dovrebbe ricevere la grazia «… nell’interesse del sistema di giustizia per cui i miei due compagni sono morti, e nell’interesse della riconciliazione e della compassione».

Nel 1977, Peltier è stato condannato a due ergastoli consecutivi per l’omicidio con arma da fuoco dei due agenti dell’FBI Jack Coler e Ron Williams nella riserva di Pine Ridge, South Dakota.
«… Le circostanze [mai chiarite, nota del traduttore] del caso e i 40 anni trascorsi sostengono la richiesta per far sì che Peltier possa trascorrere i suoi ultimi anni a casa… Quando Coler e Williams hanno perso la vita è stata una perdita devastante per noi agenti. Il processo a suo carico fu svolto sull’onda emotiva e trovare un colpevole per quelle due morti è stato l’unico obiettivo perseguito» ha scritto Ryan. «Se il governo potesse rifare tutto daccapo, lo farebbe in modo diverso. Visto con il senno di poi, oggi si può dire che Leonard Peltier non è stato trattato in modo equo e che non ha avuto un giusto processo».
Nel 2000, il deputato Don Edwards (anche lui un ex agente) ha dichiarato: «L’Fbi continua a negare la sua condotta impropria su Pine Ridge nel corso del 1970 e nel processo contro Leonard Peltier. L’Fbi ha utilizzato Peltier come capro espiatorio e continua a farlo anche oggi. In ogni circostanza, gli agenti e i capi dell’Fbi si sono opposti a qualsiasi ammissione di illecito da parte del governo, e hanno cercato di travisare e politicizzare il significato di clemenza per Leonard Peltier. L’uccisione di agenti dell’Fbi a Pine Ridge era riprovevole, ma il governo ora ammette che non è possibile dimostrare che sia stato proprio Peltier a uccidere i due agenti».
«La demonizzazione perpetua di Peltier da parte del FBI è un tentativo di avvelenare l’opinione pubblica e di evitare l’autocritica. La petizione per la clemenza a Peltier non è un referendum sulla applicazione della legge federale; è un imperativo morale che il presidente Obama può affrontare» ha detto l’avvocato di Peltier, Cynthia Dunne, lei stessa un ex procuratore federale. «Fare i conti con il passato e andare avanti nell’interesse della giustizia, nella riconciliazione e nella compassione possiamo diventare una nazione più forte. E’ il momento di liberare Leonard Peltier».
Attualmente imprigionato in una struttura di massima sicurezza in Coleman, Florida, Peltier è lontano dalla sua riserva in Nord Dakota. Il mantenimento di forti legami familiari è stato difficile. Non ha mai nemmeno incontrato alcuni dei suoi nipoti o pronipoti. Nel mese di dicembre, il figlio minore di Peltier è deceduto mentre era a Washington, lavorando per il rilascio di suo padre. Le autorità carcerarie hanno rifiutato di permettere che Peltier partecipasse al funerale di suo figlio.
A 72 anni, Peltier soffre di gravi problemi di salute che compromettono la sua capacità di camminare, vedere e condurre le normali attività di vita. Soffre di diabete grave, ipertensione e di cuore, ed è stato diagnosticato un aneurisma aortico addominale. Recentemente è stato detto che ha bisogno di un intervento chirurgico alla prostata.

The FBI used Mr. Peltier as a scapegoat and they continue to do so today. At every step of the way, FBI agents and leadership have opposed any admission of wrongdoing by the government, and they have sought to misrepresent and politicize the meaning of clemency for Leonard Peltier. The killing of FBI agents at Pine Ridge was reprehensible, but the government now admits that it cannot prove that Mr. Peltier killed the agents.” Edwards’ words ring true today. Last week, the FBIAA succeeded in pressuring American University to remove a statue of Peltier that was exhibited there, and when former U.S. Attorney James Reynolds’ letter to the President to request that he grant clemency to Peltier was publicized, some sought to discredit Reynolds stating that he falsely claimed involvement with the Peltier case. “The FBI’s perpetual demonization of Leonard Peltier is an effort to poison public opinion and avoid self-reflection. Mr. Peltier’s clemency petition is not a referendum on federal law enforcement; it presents a moral imperative which President Obama can address,” said Peltier attorney Cynthia Dunne, herself a former federal prosecutor. “By reckoning with the past and moving forward in the best interests of justice, reconciliation and compassion, we can become a stronger nation. It is time to free Leonard Peltier.” Currently imprisoned in a maximum-security facility in Coleman, Florida, Peltier is far away from his reservation in North Dakota. Maintaining strong family ties has been difficult. He has never even met some of his grandchildren or great-grandchildren. In December, Peltier’s younger son passed away while in Washington, DC, advocating for his father’s release. Prison authorities refused to allow Peltier to attend his son’s funeral. At 72 years, Peltier suffers from serious medical problems that impair his ability to walk, see, and conduct normal life activities. He suffers from severe diabetes, hypertension and a heart condition, and has been diagnosed with an abdominal aortic aneurysm. Recently, he was told he needs prostate surgery. Imprisoned for 41 years, Peltier has long been eligible for release, but federal authorities have yielded to the objections of the FBI in denying Peltier’s applications for parole—most recently in 2009 when he was told he will not receive another full parole hearing until 2024 when, if he survives, he will have reached nearly the age of 80 years. Peltier says he’s eligible for mandatory release, but the government has failed to apply its 30 -year rule (after 30 years served, all sentences are to be aggregated and the prisoner released) or consider the good-time credit he has earned (20 years, to date). Peltier’s release from prison now depends on a grant of clemency by President Obama who leaves office on January 20.
